Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MORTAR mobile application and related services ("Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

MORTAR is a productivity tool that helps contractors create quotations and invoices, manage projects, record site photos, track workers and expenses, and prepare progress claims. The Service is provided to help you run your business; it does not provide legal, accounting, tax or professional certification advice.

2. Your account

You must provide accurate information and are responsible for keeping your login credentials secure and for all activity under your account. You must be at least 18 years old and able to enter into a binding contract. Notify us promptly of any unauthorised use.

3. Acceptable use

You agree not to misuse the Service, including by: uploading unlawful content; infringing others' rights; attempting to breach security or access data that is not yours; reverse engineering the Service except as permitted by law; or using it to send spam or fraudulent documents.

4. Your content

You retain all rights to the data and content you create in the Service ("Your Content"). You grant us a limited licence to host, process and display Your Content solely to operate and provide the Service to you (for example, to render and store the PDFs you generate). You are responsible for the accuracy and legality of Your Content, including documents you issue to your clients.

5. Plans, billing & trials

MORTAR offers a Free plan and paid subscriptions (Pro and Business). Paid features, prices and limits are described in the app and may be updated. Where subscriptions are sold through the Apple App Store or Google Play, billing, renewals and refunds are handled by that store under its terms; manage or cancel your subscription in your store account settings. Taxes may apply. We may change pricing with reasonable notice; changes do not affect the period you have already paid for.

6. Important limitations โ€” please read

  • Worker & wage figures are estimates only and are not a statutory payroll system. MORTAR does not calculate, withhold or submit EPF (KWSP), SOCSO (PERKESO) or any statutory contribution. You remain responsible for your statutory obligations.
  • CIDB/compliance features are a document store and reminder tool only. They do not integrate with any official CIDB system and do not verify, certify or guarantee your registration or status.
  • e-Invoice. Until the LHDN MyInvois integration is officially released and you are notified in-app, documents created in MORTAR are standard invoices and are not submitted to LHDN.
  • Financial figures (margins, P&L) are estimates to assist your decisions and are not a substitute for proper bookkeeping or professional accounting.

7. Availability

We work to keep the Service reliable, including offline-first operation that syncs when you reconnect, but we do not guarantee uninterrupted or error-free availability. We may modify, suspend or discontinue features with reasonable notice where practical.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will meet every requirement or be free of errors.

9. Limitation of liability

To the maximum extent permitted by law, MORTAR will not be liable for any indirect, incidental, special or consequential damages, or for loss of profits, revenue, data or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the 12 months before the claim arose.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or use the Service unlawfully. On termination, your right to use the Service ends; data handling follows our Privacy Policy.

11. Governing law

These Terms are governed by the laws of Malaysia, and you submit to the non-exclusive jurisdiction of the Malaysian courts.

12. Changes to these Terms

We may update these Terms as the Service evolves. Material changes will be notified in-app or by email. Continued use after changes take effect constitutes acceptance.
